IMPORTANT NOTICE: Found Youth's services enable coordination and communication with a healthcare provider. It does not replace your relationship with any physician. These services might not be appropriate for all medical conditions or concerns. If you have a medical emergency, immediately call your doctor or dial 911.
Please read these Terms of Use carefully. By accessing or using the sites or services, you acknowledge that you have read, understood, and agreed to be legally bound by and comply with these Terms of Use.
Josela Investments LLC, and its respective affiliates (collectively, "Found Youth", "we", "us", or "our") own and operate the website located at https://foundyouth.com and any affiliated mobile application (collectively, the "Sites"). The Sites are intended to facilitate the provision of Services to registered users. Services may include:
Providing individuals with information on health care and wellness
Providing individuals with pharmacy services through The Pharmacy Hub
Development and gathering of health care records for use in provider appointments, communications, and pharmacy services
Administrative support in connection with scheduling and payment for provider services and pharmacy services
Telecommunications support for accessing healthcare providers provided by Arora Health & Aesthetics, LLC
Use of these Terms is accepting use of Bask Health Inc's platform and its applicable privacy policy located on the Bask Health website (bask.health, bask.bio).
To qualify to use the Services, the following must be true:
You are age 18 or over
You are located in a state where we operate
You agree to be legally bound by and comply with these Terms
Telemedicine involves the delivery of health care services using electronic communications between a health care provider and a patient who are not in the same physical location. Please see our Consent to Telehealth for a description of the risks and benefits of telemedicine. The Consent to Telehealth is incorporated into these Terms of Use by reference.
Please see our Privacy Policy and HIPAA Notice of Privacy Practices for descriptions of how we collect, use, and protect your information.
Found Youth does not provide any medical services. Rather, Found Youth provides a technology platform for you to access a healthcare provider employed or contracted with Arora Health & Aesthetics, LLC. The health and wellness resources made available through our Services are not a substitute for direct in-person health care services in all cases. You understand that by coordinating with an Arora Health provider through the Services, you are not entering into a provider-patient relationship with Found Youth.
A healthcare provider consulting with you through the Services may not have the benefit of information that would be obtained by examining you in person. The healthcare provider may be limited by state law in prescribing certain medications without first conducting an in-person physical examination. By using the Services, you acknowledge these limitations and agree to assume the risk.
To access the Services, you must register with Found Youth. You agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your password and for all activities under your account. Notify us immediately of any unauthorized use at support@foundyouth.com.
If you receive a prescription through the Services, your prescription will be filled by The Pharmacy Hub (15600 NW 15th Ave, Suite C, Miami, FL 33169; (888) 958-1382) or another affiliated pharmacy partner. You give us consent to send and disclose to the pharmacy all information provided by you, health care records, and other applicable personal information so that you may receive pharmacy services.
All compounded medications are prepared by a state-licensed 503A compounding pharmacy operating under Section 503A of the Federal Food, Drug, and Cosmetic Act.
Services are available only in jurisdictions where affiliated medical providers are licensed to practice and where pharmacy partners are authorized to dispense medications. Availability may vary by state and is subject to applicable laws, regulations, and licensure requirements.
You agree to pay all fees due for services requested. By entering your payment information and submitting your request, you authorize us, our affiliates, or our third-party payment processors to charge the amount due. You are responsible for all fees due for healthcare and pharmacy services.
Neither federal nor state health care programs currently pay for any of the medical services or products made available through the Services. You will pay directly for any medical services and products provided to you, and neither Found Youth nor any affiliated healthcare organization or provider will bill any federal or state health care program.
YOU EXPRESSLY AGREE THAT USE OF THE SITES IS AT YOUR SOLE RISK. THE SITES AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. FOUND YOUTH DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE EXTENT PERMITTED BY LAW, FOUND YOUTH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITES OR SERVICES.
These Terms shall be governed by the laws of the State of Delaware. Any dispute arising under these Terms will be resolved by binding arbitration in New York, New York under the rules of the American Arbitration Association.
Found Youth reserves the right at any time to modify, or temporarily or permanently discontinue, the Sites or Services or any portion thereof, with or without notice.
